PM IS a commercial vehicle!

Almost got a ticket today for driving a commercial cargo van. Took a 2 day 800 mile drive to Florida to see my mom in law. Crossed the Florida border today and got chased down quickly by law enforcement. Since I am driving a PM which is a commercial cargo van I was REQUIRED to stop for their inspection at the border. I had no idea. There is no commercial signage or anything like that on my van. The Officer even commented that I was the only one passing that point who WAS NOT SPEEDING! Apparently this is a misdemeanor violation that carries a $151 fine. I asked the officer if I should go back or what else I could do to make it right as I was ignorant of the law. He was very polite and as we talked, turned out he was a Gulf War Vet as well. I opened the hatches to let him see I had no illegal aliens or produce or anything. He took a quick look and told me to have a seat while he processed a warning for me. Then we were on our way again.
I do want to say that ignorance of the law is no excuse. I screwed up. I always take responsibility for my screw ups and stay polite and professional when dealing with LE. I feel they deserve that. Heck, that level of honestly got a speeding charge reduced for me back in 1995. The Sheriff kept offering me excuses and I kept telling him I had no excuse and screwed up. Eventually he started laughing and said I was the first honest person he had pulled over that month. He reduced the charge and I agreed there was no way I'd come back to challenge the charge in court. (That would have been incredibly disrespectful IMO and I said so.) He even entertained me with some stories about recent folks he pulled over trying to weasel out of charges. So what could have been reckless driving was turned into 7 mph over the 55 limit. That reduced the fine and points by 2/3s.
Today the officer was very professional and gracious towards me. He also iterated that the warning stays on record and if I do it again, I will get the fine and violation ticket.
I wasn't on I 95. Just tooling down Route 121 where it crosses from Ga. to Fl. We often take 301, but it had a large section closed for construction to the south. I have always been a really honest person, even when it means I'll get screwed for it. That didn't do wonders for my military career back in the day, but I sleep well. So it works for me.

As an aside the PM ran like a top. Had a great drive. Got 21 mpg for the trip down.

So, yeah, we PM drivers have to stop for commercial inspections! Hope this info saves someone else a ticket some day.

Then you find out it's a Dept of Agriculture and consumer services inspection station.

You got pulled over by the Dept of Agriculture Police

Hm. wonder if it is a Florida state specific law. I assume a PM that is registered as an RV would not be in the same situation.

i live on the west coast, California is the only one that stops anyone, and that's a mandatory stop for everyone. I wonder where a person can find individual state regulations on this.

Weird.

Personally.... No commercial registration, no dot number, no commercial vehicle insurance. And even for those weird states that broiler plate commercial vehicles with a gvwr over 10k....the Promaster has a less than 10k gvwr.

A Honda Fit could be a commercial vehicle. A Prius could be a commercial vehicle. And so could a Promaster.

What is the legal Florida definition of a commercial vehicle? If this officer couldn't give you exact reasons why your vehicle is commercial.....

The only thing you did wrong in my opinion is consent to a search.

Maybe putting a private use decal on the van would squelch this issue.

Commercial motor vehicle” means any vehicle which is not owned or operated by a governmental entity, which uses special fuel or motor fuel on the public highways, and which has a gross vehicle weight of 26,001 pounds or more, or has three or more axles regardless of weight, or is used in combination when the weight of such combination exceeds 26,001 pounds gross vehicle weight. A vehicle that occasionally transports personal property to and from a closed-course motorsport facility, as defined in s. 549.09(1)(a), is not a commercial motor vehicle if the use is not for profit and corporate sponsorship is not involved. As used in this subsection, the term “corporate sponsorship” means a payment, donation, gratuity, in-kind service, or other benefit provided to or derived by a person in relation to the underlying activity, other than the display of product or corporate names, logos, or other graphic information on the property being transported.

Van conversions,
Motor homes AND
Pickup trucks that have visible access to the entire cargo area and are not carrying agricultural, horticultural or livestock products

I'm guessing it looked more cargo then RV'ish.

It's probably up to the Officer to make the call.
